The petitioner apprehends his arrest in connection with Madhepura P.S. Case no. 01 of 2017, registered under Sections 409 and 420 of the Indian Penal Code.
The accusation is that through letter No. 1195, dated 30.08.2016 of informant Janardhan Prasad Nirala, Block Development Officer, Madhepura Sri Niwas Kumar Panchayat Teacher working at New Primary School, Manpur, Gorhiyari under Panchayat Madhepura was directed to furnish the documents regarding appointment of Panchayat Teacher, but the same was not furnished. Sri Niwash Kumar showing his appointment as Panchayat Teacher since 2010 at New Primary School, Manpur, Gorhiyari has withdrawn Rs. 4,95,000/- as
Patna High Court Cr.Misc. No.24720 of 2017 (3) dt.08-12-2017 2/2 salary where his wife Renu Bharti is headmistress. Learned counsel for the petitioner submits that while informant was Panchayat Secretary in Madanpur Panchayat in the year 2008-10, but no appointment was done between the said period and he has no concerned in issuing the appointment letter in favour of Sri Niwash Kumar, who is working since 2010.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 01 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
