JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks anticipatory bail in a case registered for the offences punishable under Sections 408,409, 419, 420/34 of the Indian Penal Code and section 27 of the Arms Act. The petitioner was Mukhia of the Gram Panchayat Raj Lakhandihra under the district of Buxar. It is alleged that while functioning as Mukhiya of the said Gram Panchayat, he purchased solar light system for installation but it was not in tune with the departmental guidelines and on the rate fixed by the Bihar Renewable Energy Development Agency (BREDA).
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.51388 of 2014 (2) dt.30-04-2015 petitioner was Mukhiya of the said gram Panchayat during the years 2005-2006-2010-2011.
In view of the above, let petitioner above named in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in Dumraon P.S. Case No. 362 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
