JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-06-2017 Heard learned counsel for the petitioner and learned APP representing the State.

Petitioner apprehends his arrest in connection with Dehri (Town) P.S. Case No. 597 of 2016 registered for the offences punishable under Sections 384, 342 of the Indian Penal Code. Allegedly, the petitioner took away Hywa vehicle loaded with 60 mm stone chips and further snatched Rs. 9,000/- from the driver and started demanding Rs. 1,50,000/- as ransom otherwise caused threats to get the vehicle again caught by the officer concerned.

Submission is of false implication and that the informant has given his vehicle to the petitioner on rent as per agreement vide annexure-2 and due to some dispute this case has been lodged. Now good sense has prevailed between the parties and

Patna High Court Cr.Misc. No.14349 of 2017 (3) dt.20-06-2017 compromise petition has also been filed in ABP No. 365 of 2017 in the court of learned Sessions Judge, Sasaram, Rohtas but prayer of pre-arrest bail was refused.

Learned APP submits that in the FIR there is serious allegation but the petitioner has got no criminal antecedent as disclosed in paragraph 3 of the application on affidavit. In the facts and circumstances stated above, considering the compromise arrived at between the parties, the petitioner above named, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Dehri, Rohtas in connection with Dehri (Town) P.S. Case No. 597 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) avin/- U T
