JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 30-04-2015 Heard learned counsel for the petitioners as well as learned counsel for the State.

In this application for anticipatory bail the petitioners apprehend their arrest for the offences punishable under sections 341, 323, 325, 354, 452 and 504/34 of the I.P.C and sections 3 (1) (X) of SC/ST Act.

It is submitted that there is case and counter case bearing Sheohar P.S. Case No. 57 of 2014. The occurrence has not been taken place at the public view and at first the occurrence took place between the children and as such the petitioners deserve sympathetic consideration, to which the learned A.P.P. fairly submits that it is a fit case for regular bail.

No.48965 of 2014 (2) dt.30-04-2015 2/2 Considering that there is some allegation of overtact against the petitioners and there is case and counter case and as such the case being a fit case for regular bail the petitioners are directed to surrender in the court of C.J.M. Sheohar in connection with Sheohar SC/ST P.S. Case No. 04 of 2014 and seek regular bail then in that case they shall be released on bail on execution of bail bonds to the satisfaction of the learned court below itself and accordingly this Criminal Miscellaneous Application is hereby disposed of.
