ANJANA MISHRA ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 28.08.2016 in connection with Kalyanpur P.S. Case No.111 of 2016 registered for the offences under Sections 272 and 273 of the Indian Penal Code and Section 47(a) of the Bihar Excise (Amendment) Act, 2016.
Learned counsel for the petitioner submits that the alleged recovery is not made from the conscious possession of the petitioner, but from a Mahila latrine. The petitioner is not having any criminal antecedents.
Considering the aforementioned facts and
Patna High Court Cr.Misc.
