2. The petitioner seeks bail in connection with a case registered for the offence punishable under Sections 383/386/ 365/34 of the Indian Penal Code and Section 50 of the Bihar Prohibition and Excise Act.
3. The prosecution case in brief is that the petitioner along with other accused persons intercepted a truck transporting alcohol and extracted an amount of Rs. 1,25,000/- (One Lakh Twenty-five Thousand) from the owner of the truck posing themselves to be police personnel.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. Petitioner himself is victim of the circumstances. He was sitting in the
Patna High Court CR. MISC. No.22284 of 2025(3) dt.09-05-2025 2/2 vehicle after taking lift and has got no concern with the alleged occurrence. Neither the looted money has been transferred in the bank account of the petitioner nor the same has been received by the petitioner. Petitioner is in custody since 24.02.2025.
5. Considering the period of custody, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. V, Gaya / concerned court in connection with Amas P.S. Case No. 210 of 2021.
