Again, I am not inclined to release the petitioner on bail on the ground mentioned by me in my previous order dated 16.02.2016 passed in Cr. Misc. No. 7366 of 2016. Accordingly, the prayer for bail of the petitioner in connection with Udwantnagar P.S.case No.382 of 2014, pending in the court of learned Additional Chief Judicial Magistrate-II, Ara, Bhojpur, stands rejected.
The prayer portion of the petition goes to show that still the case of the petitioner is pending for commitment. The petitioner is in jail custody since 23.03.2015, therefore in the aforesaid circumstance, the learned Additional Chief Judicial Magistrate-II Ara, Bhojpur/ concerned court must commit the case
Patna High Court Cr.Misc. No.55512 of 2016 (2) dt.22-02-2017 2/2 of the petitioner to the court of sessions in accordance with law within two weeks from the date of receipt/ production of a copy of this order even by separating the case of the petitioner from other co-accused and after commitment, the trial court should try to conclude the trial of the petitioner as early as possible.
