JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner seeks anticipatory bail in a case registered for the offences punishable under Sections 341, 323, 379 and 307/34 of the Indian Penal Code. Learned counsel for the petitioner has submitted that there are case and counter case for the same occurrence. He has further submitted that so far as this petitioner is concerned, there is allegation that he assaulted the mother of the informant by Lathi. It has been submitted on behalf of the petitioner that the injuries have been found to be simple in nature, sustained by the mother of the informant.

In view of the submission as above, let the

Patna High Court Cr.Misc. No.51401 of 2014 (2) dt.30-04-2015 2/2 petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bhagalpur, in connection with Sultanganj P.S. Case No. 210 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
