JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-06-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prospector for the State. Opposite party no. 2 was granted provisional bail by this Court vide order dated 02.02.2015 passed in Cr. Misc. No. 31997 of 2015 in connection with Mahila P.S.Case No. 10 of 2014 and certain directions were given to the concerned court regarding confirmation or non confirmation of the provisional bail granted to opposite party no. 2.

Learned counsel for the petitioner submits that as a matter of fact, the opposite party no. 2, refused to keep the petitioner with him and that is the reason, the petitioner has filed

Patna High Court Cr.Misc. No.9543 of 2017 (3) dt.28-06-2017 2/2 this petition for cancellation of bail granted to the opposite party no. 2 vide order dated 02.02.2015 passed in Cr. Misc. No. 31997 of 2015.

In my view, this cancellation petition has been filed under misconception and if petitioner has any grievance regarding confirmation of provisional bail granted to opposite party no. 2, she may raise her grievance before the trail court.Accordingly, this cancellation petition stands dismissed.
