JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 307, 364, 386, 120B of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that there are ten persons, who have been named accused in this case. The present case has been instituted on the basis of the complaint case lodged by the informant. He has submitted that though the petitioner's name figures in the list of accused persons, no role is attributable to him in commission of the alleged offence. He

Patna High Court Cr.Misc. No.51404 of 2014 (3) dt.30-04-2015 2/2 has further submitted that the First Information Report, as a matter of fact, has been instituted in retaliation of the earlier case instituted by the petitioner's side.

In view of the submission as above and nature of allegation, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand only) with two sureties of the like amount each to the satisfaction of Sri Raguvansh Narayan, Judicial Magistrate, Ist Class, Lakhisarai in connection with Medanichowki P.S. Case No. 28 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
