Petitioner seeks bail in Special Case No.175 of 2018 arising out of Beur P.S. Case No. 40 of 2018 instituted for the offence under Section(s) 354-B and 506 Indian Penal Code. Counsel for the petitioner submits that petitioner is in custody since 12.07.2018 having clean antecedents. It is alleged in the written report that this petitioner attempted to misbehave with 13 years old daughter of the informant while she had gone to orchard.

From the impugned order itself, it appears that victim was not medically examined. There is no statement of victim recorded under Section(s) 164 Cr.P.C.

In the facts and circumstances of the case, prayer of

Patna High Court Cr.Misc. No.79183 of 2018(2) dt.24-01-2019 2/2 the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, Patna, in connection with Special Case No.175 of 2018 arising out of Beur P.S.
