The petitioner seeks bail in Jehanabad P.S. Case No. 618/2018, instituted for offence under Section(s) 304(B) of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner is husband of deceased.

It is alleged in the written report that daughter of informant was married with this petitioner on 09.05.2015. The informant learnt on 03.08.2018 on phone that his daughter has died in her Sasural. The informant tried to contact with this petitioner but the contact could not be established. Informant has alleged that his daughter has been killed by this petitioner along with his other relatives.

Learned Addl. P.P. has submitted that in the postmortem report doctor has found Axphexical death caused by hanging.

Learned counsel for the informant has submitted that petitioner did not inform anybody and took the dead body to Gaya on Ambulance.

Learned counsel for the petitioner has submitted that independent witness in para 10 of case diary has stated that no altercation had taken place between the deceased and petitioner. Place of occurrence is mentioned in para 9 of case diary. There was no sign of any violence at the place of occurrence. Petitioner has not committed any torture with the deceased.

Petitioner is in custody since 05.08.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad, in connection with Jehanabad P.S. Case No. 618/2018, subject to the conditions that both the bailors
