2. The petitioner apprehends his arrest in connection with Biraul P.S. Case No. 595 of 2023, registered for the offences punishable under Sections 363, 366(A)/34 of the IPC.

3. As per FIR, the marriage of daughter of the informant was solemnized with co-accused Rahul Kumar Chaudhary. The husband and his family members committed dowry death of the informant's daughter for which Hayaghat P.S. Case No. 95 of 2023 was registered. During pendency of that case, Rahul Kumar Chaudhary along with ten named accused persons came to the house of the informant and he

Patna High Court CR. MISC. No.22933 of 2025(4) dt.12-11-2025 2/3 forcibly took away his three children along with 15 years minor daughter of the informant.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. The petitioner is not related to Rahul Kumar Chaudhary and he is co-villager. The victim although named the petitioner in her statement under Section 164 of the Cr.P.C., but there is no allegation of committing rape against the petitioner rather this allegation is against co-accused Rahul Kumar Chaudhary. The petitioner has falsely been implicated merely because he is covillager of the informant.

5. On the other hand, the learned APP for the State and the learned counsel for the informant have opposed the prayer for bail.

6. The petitioner is co-villager of the informant. There is no allegation of rape against him. He is a person of clean antecedent.

7. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount
