JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 363, 334 and 365/34 of the Indian Penal Code. Petitioner is named in the first information report on the accusation that she as well as other F.I.R. named accused took the informant's son from his house.

In course of investigation, paragraph-13 of the case diary goes to show that victim was recovered and brought to his home safely.

Learned counsel for the petitioner submits that petitioner has been implicated in this case due to village politics and previous enmity and, moreover, it has not been mentioned in

Patna High Court Cr.Misc. No.27018 of 2016 (3) dt.30-08-2016 2/2 paragraph-3 as to from where the victim was recovered. Petitioner is in jail custody since 14.12.2015 and she does not have any criminal antecedent and apart from this, the purpose of so-called kidnapping has also not been given either in the fardbeyan or in the statement of witnesses. The investigation against the petitioner has already been completed. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Vaishali at Hajipur in connection with Vaishali P.S. Case No.366 of 2015.
