JUSTICE MADHURESH PRASAD) Date : 07-04-2023 The writ petition has been filed as a Public Interest Litigation with a prayer for issuance of direction to the respondent-Authorities for converting the "WanawarKoteshwarnath Dham Halt" into a full fledged railway station. Whether the halt is to be converted into a proper railway station or not is essentially a matter of executive policy, depending upon various factors such as otherwise accessibility of the place, its importance, number of persons visiting, population of the place itself, its topography, financial implications, etc..
In respect of such policy matters, the writ court has consistently been refusing to exercise its discretionary jurisdiction, treating such policy decisions to be beyond the scope of judicial review.
