ANJANA MISHRA ORAL ORDER 30-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with Complaint Case No. 279/2013 registered for the offences punishable under Sections 406, 420, 504/34 of the Indian Penal Code.
Learned counsel for the petitioner had earlier given an undertaking to this Court that the matter would be compromised and the money in question would be returned to the complainant. However, learned counsel for the petitioner submits that the document Annexure-2 to this application, clearly reveals that the
Patna High Court Cr.Misc. No.49211 of 2014 (5) dt.30-04-2015 P2/2 money in question has already been returned to the complainant and thus no payments are due to the O.P. No. 2. However, after comparing the signature available on the deed of agreement between the parties and also the receipt which has been filed, I am not satisfied that it is an authentic document. In view of the above facts and circumstance of the case, I am not inclined to grant anticipatory bail to this petitioner. It is accordingly rejected.
