The petitioner seeks bail in Islampur P.S. Case No. 308 of 2018, instituted for the offence under Section(s) 147, 149, 341, 342, 323, 504, 506, 325, 307 and 379 of the Indian Penal Code.
Counsel for the petitioner submits that there is no allegation of any specific overt act against the petitioner. It is alleged in the written report that petitioner along with other nine accused persons as named in the written report assaulted the informant with lathi, danda, iron rod etc. causing injury to the informant on different parts of his body. The injury report of the informant has been enclosed as Annexure-3 which shows that although the informant
Patna High Court CR. MISC. No.20581 of 2019(2) dt.03-04-2019 2/2 received as many as ten injuries, but all were simple in nature caused by hard and blunt substance. The injuries were bruise, abrasion etc.
Petitioner is in custody since 18.2.2019 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda, in connection with Islampur P.S.
