ANJANA MISHRA ORAL ORDER 17-04-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 28.12.2018 in connection with Supaul P.S. Case No.683 of 2018 registered for the offence under Section 379 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is not named in the FIR, but subsequently the alleged stolen vehicle was recovered from the front of the shop of the petitioner which led to a suspicion that the petitioner was involved in the occurrence and therefore the petitioner has been taken into custody.

Considering the aforementioned facts and circumstances and that the alleged recovery was not from his conscious possession, let the petitioner, above named, be

Patna High Court CR. MISC. No.24847 of 2019(2) dt.17-04-2019 2/2 released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Supaul, in connection with Supaul P.S. Case No.683 of 2018.
