JUSTICE SANJAY PRIYA ORAL ORDER 18-07-2017 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in Barun P.S. Case No. 180 of 2013 instituted for the offence under Sections380, 354 & other minor sections of the Indian Penal Code and 27 of the Arms Act.

It has been submitted that petitioners were granted police bail in the year, 2014 during investigation. Thereafter, charge sheet has been submitted in this case under Sections-380, 354 & other minor sections of the Indian Penal Code and 27 of the Arms Act.

No.30178 of 2017 (3) dt.18-07-2017 In such circumstances, since the petitioners have already been granted police bail in the year, 2014, this application is disposed off, with direction to the petitioners to surrender in the court below within four weeks from today and seek regular bail. In the event, petitioners surrender in the court below, their regular bail application will be disposed off on the same day taking into consideration that petitioners were allowed police bail and their prayer will not be declined unless there is allegation against the petitioners of misuse of bail or tampering with the prosecution witnesses.
