JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-01-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Vaishali P.S. Case No. 81 of 2015 registered under Sections 363, 364, 366A, 372 of the Indian Penal Code. The accusation is of kidnapping of Shobha Kumari aged about 17 years, daughter of the informant by three unknown boarding her in Bolero vehicle and the occurrence is said to be seen by one villager Papu Singh.

Learned counsel appearing on behalf of the petitioner submits that on the basis of written report of informant Baiju Singh, Vaishali P.S. Case No. 81 of 2015 was instituted against unknown regarding the kidnapping of his manor daughter.

No.47097 of 2015 (3) dt.27-01-2016 2/2 In course of investigation, suspicion was raised against the petitioner by wife of Pappu Singh only on the ground that the petitioner was absent at his house on the date of occurrence. Except that, there is nothing against the petitioner. Moreover, victim Shobha Kumari was recovered by the Police from Faridabad in the rental house of Kapur Nath along with coaccused Md. Imran, as detailed in paragraph no. 17 of the case diary and the victim in her statement under section 164 Cr. P.C. has not stated anything against this petitioner.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Vaishali at Hajipur in connection with Vaishali P.S. Case No. 81 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
