Petitioner seeks bail in Dalsinghsarai P.S. Case No.11 of 2020 registered under Sections 395 and 397 of the IPC. The informant lodged the case against unknown for dacoity in his house.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. The name of the petitioner surfaced in the case in the confessional statement of co-accused Gautam Kumar @ Gautan Kumar Paswan. The petitioner was arrested on 02.02.2020 but the petitioner has not been put on T.I.P. No looted article has been recovered from possession of the petitioner.

Having considered the facts that the petitioner is not named in the F.I.R. and the name of the petitioner surfaced in

Patna High Court CR. MISC. No.25033 of 2020(2) dt.21-09-2020 2/2 the case in the confessional statement of co-accused but the petitioner has not been put on T.I.P. although he is in custody since 02.02.2020, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned C.J.M., Samastipur in connection with Dalsinghsarai P.S. Case No.11 of 2020.
