21-08-2020 Earlier, vide order dated 10-07-2020, a show cause was asked from the court below as to how the bail application of petitioner was entertained when the petition for regular bail of the petitioner was pending before this Court. In compliance thereof, show cause reply, vide letter no. 187 dated 4th August, 2020, has been received from learned Addl. District Judge-II-cum-Special Judge, Excise Act, Begusarai, which is kept at flag 'A'. On perusal of the same, it appears that the fact regarding pendency of bail petition before this Court was concealed in the 2nd bail petition filed before the court below and as such, considering the fact that petitioner is in custody since 09-02-2020 and other co-accused persons have already been granted bail, the learned Special Judge has granted

Patna High Court CR. MISC. No.21987 of 2020(3) dt.21-08-2020 2/2 bail to the petitioner. In show cause reply, the learned Special Judge has also stated that as per law, a proceeding has already been initiated against petitioner Bhandari Paswan. The show cause explanation, submitted by learned Special Judge, Begusarai, is accepted with direction to him to remain careful in future.

The proceeding, initiated against petitioner, be concluded as early as possible.

In view of aforesaid facts, the present bail application stands disposed of.
