JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-06-2019 Petitioner seeks bail in anticipation of his arrest in connection with Danapur P.S. Case No. 759 of 2018 registered for the offences punishable under Sections 363 and 366 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping of the minor daughter of the informant along with other accused persons.

Submission of learned counsel for the petitioner is that as a matter of fact she had love affair with the brother of the petitioner and as such she fled away and she is residing with him and petitioner has no knowledge about the same and he has been made accused only because he is brother of Sujit Kumar and falsity of the case will appear from the fact that father of petitioner who died long back has also been made accused in

In view of above facts and circumstances, let petitioner, in the event of surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Danapur, in connection with Danapur P.S. Case No. 759 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner has to cooperate in the investigation and appear before the police as and when required.
