Mr.Rabindra Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 22-05-2023 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Pakaridayal P.S. Case No. 161 of 2022 for the offence under Sections 302, 120B, 34, 506 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and she is in custody since 19.09.2022.

The prosecution story is that the informant's son was sitting at his door with his co-villagers in the meantime accused persons namely Raju Rai, Ramakant Rai, Lalu Rai, Vikash Rai came along with two others at his darwaja and took away the informant's son with them towards the village. It is further alleged that the informant got information from the villager that his son

Patna High Court CR. MISC. No.23420 of 2023(2) dt.22-05-2023 2/2 was stabbed and he was badly injured. The informant reached hospital for treatment where the doctor declared the victim dead. The petitioner is not named in the F.I.R but her name has come in the confessional statement of the co-accused. Nothing incriminating has been recovered from the possession of the petitioner. The petitioner is in custody since 19.09.2022 and she has clean antecedent.

Considering the fact that the petitioner has got no criminal antecedent and period of custody, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Pakaridayal P.S. Case No. 161 of 2022.
