The petitioner is languishing in custody for the offences punishable under Sections 304(B)/34 of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act in connection with Ariyari (Kasar) P.S. Case No. 165 of 2017.

Petitioner is husband of the victim of dowry death. Marriage was solemnized in the month of May, 2017. There is allegation of demand of more dowry and torture for the same soon before death. The witnesses have supported the allegation of demand of dowry and torture before the police. Evidence is that victim died in unnatural circumstances in her matrimonial house.

Hence, the presumption of law is their against the

Patna High Court CR. MISC. No.76550 of 2018(6) dt.16-04-2019 2/2 petitioner of commission of dowry death, therefore, I am not inclined to enlarge him on bail. Hence, his prayer for bail is refused.

Learned Trial Court is directed to expedite the trial. It has been informed that petitioner is suffering from illness mainly psychiatric problems. The Jail Superintendent shall take appropriate step for immediate treatment of the petitioner and shall submit a report to the Court below regarding status of illness and treatment of the petitioner. Let a copy of this order be sent to the Jail Superintendent, where the petitioner is in custody.
