====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 26-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Vidhyapati Nagar P.S. Case No. 110 of 2018 (5133029180110) instituted for the offence under Section(s) 272, 273 of the Indian Penal Code 1860 and Section 30(a) of Bihar Prohibition and Excise Act, 2016.

Counsel for the petitioner submits that there is no recovery of any illicit liquor from possession of the petitioner. From the written report it appears that recovery has been made from the Motorcyle of co-accused Shankar Suman in his house. He further submits that co-accused Shankar Suman and Raju Kumar Singh have already been granted bail by coordinate

Petitioner is in custody since 10.10.2018.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IIIrd cum Special Judge, Excise at Samastipur, in connection with Vidhyapati Nagar P.S. Case No. 110 of 2018 (5133029180110), subject to the condition that both the bailors will be the close relatives of the petitioner.
