JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 18-04-2022 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioners as well as learned APP for the State.

The petitioners apprehend their arrest in connection with Araria P.S. Case No. 749 of 2020, registered for the offences punishable under Sections 366 (A), 341, 342, 323, 34 of the Indian Penal Code.

Sunita Devi, is the informant. As per allegation, the petitioners along with co-accused persons forcibly lifted the minor daughter of the informant. When the informant and her husband went to the house of the accused persons, they tied them with khoonta and badly assaulted with fists and slaps.

Patna High Court CR. MISC. No.31765 of 2021(3) dt.18-04-2022 2/2 Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. He has further submitted that there is delay of two weeks in lodging the FIR.

The victim was recovered and her statement under Section 164 of the Cr.P.C. was recorded. She has stated in her statement that when she went out for bringing some articles from a shop, the petitioners forcibly got her seated on a motorcycle and she was brought to the sister's house of the petitioner, Mithilesh Rishideo. The victim has fully supported the prosecution version. As per allegation the petitioners forcibly got her seated on a motorcycle and kidnapped her, as such, I do not think it a fit case for anticipatory bail.

Accordingly, it is rejected.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
