JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 22-08-2023 Mr. Sanjay Kumar, learned counsel for the petitioner submits that this writ application was filed for a direction to the respondents to upgrade the status of Manjhauli Middle School, Bakhtiyarpur as High School as per notification no. 1021 dated 05.07.2013.

2. It is submitted that during pendency of the writ application, the school has already been upgraded, hence, so far as the present writ application is concerned, it has become infructuous.

3. Learned counsel, however, submits that so far as CWJC No.8667 of 2023 is concerned, the lis involved in the

Patna High Court CWJC No.6420 of 2022(3) dt.22-08-2023 2/2 said writ application pertains to the proceeding by which the respondent authorities recommended the selection of Middle School in Gram Panchayat Manjhauli for upgradation as High School, therefore, in CWJC No.8667 of 2023 the petitioner of present writ application is a necessary party.

4. While disposing of the present writ application as having become infructuous, this Court grants liberty to the petitioner to file an appropriate application in CWJC No.8667 of 2023 seeking intervention which will be considered on its own merit.
