The petitioner seeks bail in Masharakh P.S. Case No. 258/2014 registered under Sections 302, 201/34 of the Indian Penal Code corresponding to Sessions Trial No. 172/2015. The informant alleged that the petitioner and other accused persons killed his daughter and threw her dead body. The dead body of the daughter of the informant was recovered. The petitioner is the husband of the deceased. Almost all the witnesses have supported the case that the petitioner killed the daughter of the informant.

Considering the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on bail in Masharakh P.S. Case No. 258/2014, corresponding to Sessions Trial No. 172/2015. Accordingly, the same is rejected.

Patna High Court Cr.Misc. No.54470 of 2016 (2) dt.12-01-2017 2/2 Since the petitioner is in jail since 29.12.2014, the trial court is directed to hold the trial on day-to-day basis and conclude the same within nine months from the date of receipt/production of copy of this order.

The Superintendent of Police, Saran is directed to ensure the attendance of the non-examined prosecution witnesses of Masharakh P.S. Case No. 258/2014, corresponding to Sessions Trial No. 172/2015, in the court of learned Additional Sessions Judge VIII, Saran at Chapra so that the trial must be concluded within nine months.

Let copy of this order be sent to the Superintendent of Police, Saran as well as the learned trial court for the needful. (Prabhat Kumar Jha, J) Dilip/- U T
