JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-01-2019 Petitioner apprehends his arrest in connection with Bhawanipur P.S.Case No. 169 of 2018 registered for the offences punishable under Sections 406, 420, 419, 467, 468 and 471 of the Indian Penal Code.

Petitioner happens to be Cashier of the Central Bank of India, Brahamgyani Branch, Purnea and allegation against the petitioner and one Pawan Kumar Verma is that certain irregularities were found to have been committed by the Bank by depositing amount by the customers.

Submission of learned counsel for the petitioner is that whatever amount said to have been unauthorizedly withdrawn has already been deposited in the account and there is no mismatch in the account and moreover one Assistant Manager of the said Bank, namely, Pramod Kumar Verma, has been granted anticipatory bail vide order dated 18.12.2018 in Cr.Misc.No. 69190 of 2018. Further

Patna High Court Cr.Misc. No.77794 of 2018(2) dt.03-01-2019 2/2 submission is that petitioner is facing departmental proceeding and still he is under suspension.

Having heard both sides and in the facts and circumstances and also considering the fact that co-accused has already been granted anticipatory bail, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Purnea, in connection with Bhawanipur P.S.Case No. 169 of 2018, G.R.No. 2878 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in investigation and appear before the police as and when required, otherwise his bail bond shall be cancelled.
