The petitioner is languishing in custody since 20.07.2018 in connection with Parsa Bazar P.S. Case No.209 of 2018 registered for the offences punishable under Section 392 of the Indian Penal Code.
Prosecution case as per the fardbeyan of Md. Nasrullah submitted to the Punpun P.S. is to the effect that on 17.07.2018 at 10.30 P.M., the informant along with one more person, namely, Javed hired an auto rikshaw from Danapur Railway Station for going to Mithapur Bus Stand and before boarding on the said auto, the said Javed took photograph of the said auto-rikshaw and its registration number details. After travelling for some time, two more persons got in the auto rikshaw and subsequently they drove the auto rikshaw to a deserted place and took away four mobile
Patna High Court Cr.Misc. No.76874 of 2018(3) dt.25-01-2019 2/2 phones, two ATM cards, two bags and Rs.6000/- from the informant.
It is submitted by learned counsel for the petitioner that the name of the petitioner sprang up during investigation of two another auto rickshaw drivers. From the possession of the petitioner, alleged stolen clothes and mobile phones were recovered. It is further submitted that the petitioner has not been put on TI parade. It is further submitted that other co-accused has been granted bail by a coordinate Bench of this Court vide order dated 11.01.2019 passed in Cr. Misc. No.73779 of 2018. Considering the fact that investigation has already been concluded but the petitioner has not been put on T.I. parade and coupled with the statement made in para 3 of the bail application to the effect that the petitioner is not having criminal antecedent, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.10000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Patna in connection with Parsa Bazar P.S.
