JUSTICE ARUN KUMAR ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner apprehends his arrest in connection with Complaint Case No.857(C) of 2013 registered under Sections 420, 504 and 465 of the Indian Penal Code.

Allegation is that after taking consideration money, sale deed was executed by the holder of power of attorney given by this petitioner. The complainant went to the land but learnt that already the same was sold by sons of the second wife of this petitioner.

It is submitted by learned counsel for the petitioner that the petitioner had given power of attorney to Upendra Kumar. The land was executed in favour of the complainant but he had no

Having considered the said facts and circumstances, as the dispute primarily appears civil in nature, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let petitioner, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Danapur in connection with Complaint Case No.857(C) of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
