This matter has been placed before us in view of an order passed on 9.1.2009 wherein finding there to be some observation in a judgment rendered by the Division Bench on 24.9.2008, whereby L.P.A. No.482 of 2008 was dismissed on the ground that violation of 25F of the Industrial Disputes Act is subject to challenge in an industrial dispute under the Industrial Disputes Act, the matter has been referred to this Bench. It is stated that while doing so, certain Division Bench judgments of this Court earlier passed have not been taken note of in the matter of payment of compensation to the employees of the Marketing Board in C.W.J.C. No.334/1982, disposed on 28.7.1982.

It seems that with the passage of time the applicant is no more interested in the matter. Keeping the legal question open for consideration in an appropriate case, for the present, finding no indulgence to be made in the matter, we dispose of the matter. In case the petitioner has any grievance still subsisting, he shall be at liberty to raise the same under the provisions of Industrial Disputes Act, 1947.
