The petitioners seek bail in Madhepura P.S. case No. 622 of 2016 under Section 420, 467, 468, 471, 379 and 511 of the Indian Penal Code.
The informant alleged that petitioners and others were trying to break the lock of the dicky of motor cycle parked in front of a bank. On alarm, the petitioners managed to flee away on a motor cycle with the third accused but on chase the petitioners were apprehended and they disclosed that they committed similar nature of crime in different parts of the country. The learned counsel for the petitioners submits that
Patna High Court Cr.Misc. No.54866 of 2016 (4) dt.20-04-2017 2/2 attempt to commit theft was made but no theft was committed. The petitioners have got criminal antecedent and they are accused in four other cases of similar nature but in all these cases the petitioners are not named in the FIR. The petitioners are in jail since 30.09.2016. The petitioners have already remained in jail for six and half months.
Considering the facts aforesaid and the nature of allegation made against the petitioners, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in Madhepura P.S. Case No. 622 of 2016 subject to condition that one of the bailors shall be father of the petitioners.
