JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-03-2019 This is an application for grant of anticipatory bail in connection with Itarhi P.S. Case No. 242 of 2018, disclosing offences under Sections 341, 323, 406, 504, 506, 509/34 of the Indian Penal Code.

Allegation against the petitioner is that he has taken Rs.1,75,000/- from the informant on the plea of marriage of his sister and when the informant demanded the same back, he refused to pay back.

Submission of learned counsel for the petitioner is that there is no chit of paper is available in support of the allegation of taking Rs.1,75,000/- and the whole case is false and concocted. Further submission is that the informant was made party in this case as opposite party no.2 and notice has

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar, in connection with Itarhi P.S. Case No. 242 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
