====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-12-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner has been in custody since May, 2019 in connection with Maranchi P.S. Case No. 70/2018 registered for the offences punishable under Sections 302 of the Indian Penal Code and Section 27 of the Arms Act.
As per the prosecution case, this petitioner has opened fired at the son of the informant resulting into his death. It is submitted on behalf of the petitioner that the petitioner has been falsely implicated in this case. It is further submitted that from the perusal of the FIR itself, it is apparent that the informant is not an eye-witness of the case rather after finding the dead-body of his son near the railway track, false and fabricated story has been made out by the informant.

No.24253 of 2020(4) dt.07-12-2020 2/2 However, learned counsel for the State has opposed the bail application and has submitted that petitioner is named in the FIR and there is specific allegation of firing resulting into death of the deceased. He has got criminal antecedent and is accused in 21 criminal cases as referred in para 3 of this petition and there is all likelihood of committing offence, if released on bail.
Considering the aforesaid facts and circumstances of the case and there is serious and specific allegation against this petitioner and also keeping in view criminal antecedents, I am not inclined to grant bail to this petitioner. It is, accordingly, rejected.
However, the trial court is directed to conclude the trail as early as possible.
