The petitioner has prayed for regular bail in a case instituted for the offence under Section 414 of the Indian Penal Code.

The allegation against the petitioner and another is that, a stolen Sumo Victa car has recovered from them. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He has committed no offence. Petitioner has apprehended on spot. The petitioner was not participated in the alleged theft nor police caught him from said vehicle and entire story made in the FIR against the petitioner is creation of mind of the informant. He further submitted that the petitioner has never confessed his

No.24937 of 2023(2) dt.23-05-2023 2/2 guilt in the alleged occurrence nor he has made any confessional statement rather informant has obtained his signature forcibly on a plain paper and later on, the same has converted into his self confessional statement. He is languishing in judicial custody since 27.12.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned J.M.- 1st Class, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 385 of 2022.
