JUSTICE SANJAY PRIYA ORAL ORDER 08-04-2019 Heard learned counsel for the petitioner and the learned counsel for the informant as well as A.P.P. for the State. The petitioner seeks bail in Khaira P.S. Case No. 130 of 2017, instituted for the offences under Sections 341, 323, 324, 307,504,379, 34 of the IPC.

It is alleged in the written report that this petitioner has assaulted the informant with sword on the neck which hit his head and he sustained head injury. The injury report has been annexed as Annexure-4 to this petition which shows that the injured has sustained grievous injury. In the injury report doctor has opined one incised wound over right parietal region of skull size 3"x1/4" deep skin, and C.T. scan of injured shows that his right parietal is displaced and communicated fracture

In such circumstances, looking into specific allegation, this court is not inclined to grant bail to petitioner. The prayer for bail is rejected.

The petitioner will be at liberty to renew the prayer for bail after six months if no substantive progress is made in the trial.
