2. The petitioner seeks bail in a case registered for the offence punishable under Sections 126(2), 115(2), 118(1), 109, 352, 351(2) and 3(5) of the B.N.S..
3. As per prosecution case, it is alleged that on 11.05.2025, sons of this petitioner cut the mango tree of informant and when informant, along with her husband, went to the house of this petitioner to enquire about the same, this petitioner assaulted husband of informant with deadly weapon and thereafter, co-accused Gyanti Devi and Radheshyam Kushwaha came and assaulted informant's husband with lathi and danda due to which he sustained multiple injuries and was
Patna High Court CR. MISC. No.24091 of 2026(3) dt.21-07-2026 2/2 brought to Mairwa Private Hospital from where he was referred to B.R.D. Medical College, Gorakhpur and during course of treatment, husband of informant died. As per post mortem report, the deceased died due to ante mortem injury caused on his head by hard and blunt object.
4. Considering the facts and circumstances of the case, specific and direct nature of accusation and fact that petitioner is one of the assailant of the deceased, the prayer for grant bail of to the petitioner is rejected.
5. However, considering the fact that petitioner is in custody since 08.09.2025, the learned trial court is directed to expedite the trial and conclude the same, preferably within a period of one year from the date of receipt/production of a copy of this order.
