JUSTICE SUDHIR SINGH ORAL ORDER 26-10-2016 A supplementary affidavit has been filed on behalf of the petitioner. The same may be kept on the record. Heard learned counsel for the petitioner and learned counsel for the Opposite Party.

The present application has been filed for modification in the order passed in Cr. Misc. No. 33126 of 2016 dated 23.09.2016 for the offences instituted under Sections 147, 148, 149, 323, 325, 307, 427, 337 and 379 of the Indian Penal Code.

The allegation against the petitioner is that due to non-fulfillment of the payment of extortion money by informant to the petitioner, informant and other members of his family were assaulted by the petitioner and other accused persons. It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.45637 of 2016 (2) dt.26-10-2016 2/2 in the order dated 23.09. 2016, passed in Cr. Misc. No. 33126 of 2016, the name of the father of the petitioner has wrongly been typed.

Considering the facts and circumstances of the case, let the same be read as 'Late Md. Islam' in place of 'Md. Akbar'. The order dated 23.09.2016 stands modified to the extent, as indicated above.

With the aforesaid modification, the present application is disposed of.
