2. The petitioner is apprehending arrest in connection with Amarpur P.S. Case No. 158/2023 registered on 11.03.2023 for the offences punishable under Sections of the Indian Penal Code.
3. As per the prosecution, the FIR has been lodged against 11 named accused persons including the present petitioner that all the accused persons in connivance with each other and having armed with lathi and danda started abusing the informant. On protests being made, they assaulted the informant's family members. The specific allegation of assault
Patna High Court CR. MISC. No.25310 of 2024(2) dt.01-05-2024 2/3 is against co-accused Shekhar Tanti, Pratap Tanti, and Rajkumr Tanti to the informant's wife and daughter as well as the informant also.
4. It is submitted by learned counsel for the petitioner that the petitioner is innocent and has committed no offence. The petitioner and the informant are well known to each other and in the background of the land dispute, the accusation has been levelled which itself reflects from a perusal of the contents of the FIR. For the same place and date of occurrence, two cases have been lodged. One from the petitioner's side being Amarpur P.S. Case No. 159/2023 whereas the informant's side has lodged Amarpur P.S. Case No. 158/2023. Moreover, the allegation against the petitioner is omnibus and general and his antecedent is clean.
5. Learned APP for the State opposes the prayer for bail of the petitioners.
6. In the facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of 6 weeks from today, on furnishing bail bond of ₹30000/- (thirty thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Banka, in connection with Amarpur P.S. Case
