It has been informed that petitioner no.1- Shrimukhiya and petitioner no.5- Ram Ekbal Mukhiya have already been arrested. Hence, their prayer for anticipatory bail has become infructuous.
Submission of the learned counsel for the petitioners is that the informant is not eye witness of the occurrence and only on suspicion, the present case has been lodged.
Considering the aforesaid facts and circumstances, let the petitioner Nos. 2, 3 and 4, namely, Jiya Mukhiya @ Jiya Lal
Patna High Court Cr.Misc. No.3751 of 2017 (2) dt.17-02-2017 2/2 Mukhiya, Vikas Mukhiya @ Vikas Kumar and Bhola Mukhiya, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari/ Successor Court in connection with Muffasil P.S.
