The petitioner seeks bail in a case registered for the offence punishable under Sections 363, 366 (A), 323, 504/34 of the Indian Penal Code.

Submission is that informant namely Mahendra Paswan his wife and daughter Jitani Kumari has gone to attend call of nature on 16.05.2018 at 2 P.M. After some time his wife returned back weeping along and narrated him that when she alongwith her daughter reached near pond, all the three named accused persons, including the petitioner came there and tried to take away her daughter. The petitioner is innocent and he has committed no offence and has falsely implicated in this case due to enemity land dispute and village politics which reveals from the FIR. As per FIR occurrence has taken place on 16.05.2018, whereas FIR has been instituted on 23.05.2018 after about one week without any valid reason and allegation levelled against the petitioner is general nature and not specific.

The petitioner is in custody since 10.01.2019. In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Majorganj P.S. Case No. 197/2018, subject to the following conditions:

(1) One of the bailors will be his own blood relative, preferably, father, mother brother, sister and/or his wife.

(2) The petitioner shall not indulge himself in any similar offence till conclusion of the trial.

(3) The petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, his
