JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 401/34 of the Indian Penal Code.

Although, the petitioner is said to have been caught along with others in suspicious condition and does have criminal antecedents but in the present case nothing was recovered from the conscious possession of the petitioner when the petitioner was arrested.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.78763 of 2018(2) dt.18-01-2019 2/2 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Bhagalpur, in connection with Nathnagar Lalmatia P.S. Case No. 73/2018.
