JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-12-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

This is an application for grant of regular bail for offences punishable under Sections 413, 414 and 34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that it has been alleged that a stolen motorcycle has been recovered from the possession of the petitioner but from the seizure list it does not appear that which motorcycle has been recovered from the petitioner as his motorcycle was recovered. It has further been submitted that petitioner has been languishing in judicial custody since 22.06.2016.

Heard learned A.P.P. also.

No.55507 of 2016 (2) dt.23-12-2016 2/2 Considering the facts and circumstances of the case, nature of offence and period of detention, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M - VIII, East Champaran at Motihari, in connection with Dumariaghat P.S. Case No. 64 of 2016 with the condition that one of the bailors of the petitioner shall be his close relative having sufficient means within the territorial jurisdiction of the concerned court and if, in future, the petitioner is found to be involved in any of the said act, the bail bond of the petitioner shall be cancelled.
