Petitioner is in custody in connection with Sadar P.S. Case No. 184 of 2018 for the offence under sections 30(9), 32(ii) and 38(2) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner would submit that petitioner has no criminal antecedent.

He further submitted that the recovery was not made from the conscious possession of the petitioner. He has been made accused in this only because he is son of Bhushan Yadav from whose house alleged liquor was seized by the police. Considering the fact that the petitioner has no criminal antecedent and he is in custody since 3.11.2018, let the
