2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 379, 411 , 401 , 413 , 201 and 120 B of the Indian Penal Code .

3 . As per prosecution case , on the alleged date and time of occurrence, co-accused Manish Kumar was apprehended on the spot with stolen motorcycle and co-accused Shiv Nandan Kumar disclosed the name of this petitioner as one of his associates.

4. Learned counsel for the petitioner submits that petitioner has been made accused only on the basis of suspicion . The name of this petitioner transpired on the confessional statement of co-accused Shiv Nandan Kumar. No

Patna High Court CR. MISC. No.32561 of 2024(3) dt.13-09-2024 2/2 stolen motorcycle was has been recovered from the possession of this petitioner. Petitioner has got no criminal antecedent of similar nature .

5 . Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Gaya in connection with Bodhgaya P.S. case No. 316 of 2021 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
