JUSTICE SUDHIR SINGH ORAL ORDER 03-02-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in connection with Malsalami P.S.Case No. 76 of 2015 instituted under Sections 147, 149, 341, 323, 325, 307, 379, 504, 506 of the Indian Penal Code.
It is alleged that altogether 27 persons came and made assault to the informant on his head and when the brother of the informant came to rescue, he was also assaulted and gold chain and cash of Rs. 950/- were snatched.
It is submitted on behalf of the petitioner that altogether 27 persons have assaulted the informant on his head. No
Patna High Court Cr.Misc. No.48394 of 2015 (2) dt.03-02-2016 2/2 specific injury has been attributed against the petitioner. General and omnibus allegation has been made. Injury is simple in nature. It is a case and counter case. Other co-accused have been granted anticipatory bail vide Cr. Misc. no, 36208 of 2015 and Cr. Misc. No. 44295 of 2015.
On behalf of the State, it is submitted that the petitioner I named in the FIR.
Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Ram Sujan Pandey, learned J.M., Patna City in connection with Malsalami P.S.Case no. 76 of 2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
