The petitioner seeks bail in Sitamarhi (Punaura O.P.) P.S. Case No. 614/2016, registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 47(A) of the Bihar Excise (Amendment) Act, 2016. The informant is SHO of Punaura O.P. who, on secret information, proceeded towards Punaura Chowk where he saw two persons coming by motorcycle. The police party suspected some foul play and apprehended both of them. From their possession 32 plastic bottles, each containing 300ml wine, were recovered.

Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in the case. His further

Patna High Court Cr.Misc. No.637 of 2017 (2) dt.11-01-2017 2/2 contention is that co-accused Mithu Kumar, having similar allegation, has been allowed bail in Cr. Misc. No. 53454/2016. Learned Additional P.P. opposed this submission. The petitioner is in custody since 18.09.2016 for allegedly carrying 32 bottles of wine. Co-accused Mithu Kumar has been allowed bail.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi (Punaura O.P.) P.S. Case No. 614/2016.
