Petitioner seeks regular bail in connection with Town PS Case No. 139/2022 registered for the offence punishable under Sections 30(a) of Bihar Prohibition & Excise (Amendment) Act 2018.

16.51 litres of illicit liquor has been recovered from the motorcycle as well as from the house of the petitioner. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has got no criminal antecedent and is in custody since 16.03.2022. He next submits that the house from where

Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner has got no criminal antecedent, he is in custody since 16.03.2022, the house from where recovery of illicit liquor has been made, is a joint family house and other family members of the petitioner also reside there, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, PRAHLAD KUMAR @ PRAHLAD SINGH be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Special Court, Excise 1st, Aurangabad in connection with Town PS Case No. 139/2022.
